agreed that the act 'Artista dance experience'
(as shown on Showbird.com when this booking was made)
will be performed on Saturday 21 January 2017 between 20:00 and 23:00
on the following occasion:
Event: Company party '25 years of Customero'
Location: Feestgracht 116, Utrecht
For the sum of € 750, including all expenses of the Contractor and VAT.
The Client must take care of:
Space required: indoors or outdoors, stage of at least 3x4 meters
Rider Contractor: 2 electricity connections, 1 stack of towels, bowl of blue M&Ms
The Contractor must take care of:
Sound installation
Special agreement:
Ok, 750 is good, but then half an hour shorter, so 2.5 hours in total.
2. ShowBird
The Contractor and the Client hereby declare that this binding booking was made through the mediation of Showbird Nederland B.V. and that the terms of use as published on showbird.com also apply to this agreement. ShowBird also takes care of the payment and administrative processing on behalf of both parties.
Substantive coordination about the performance takes place between the Contractor and the Client.
3. Nature of the Agreement
3.1 This agreement does not concern an employment relationship, but a single assignment to perform a performance.
Solo Artist: This agreement is identical to the agreement assessed by the tax authorities on 07-10-2015 under number 9101586370-1.
Group Artists: This agreement is identical to the agreement assessed by the tax authorities on 07-10-2015 under number 9101586370-2.
DJ: This agreement is identical to the agreement assessed by the tax authorities on 12-10-2015 under number 9081593705.
4. Termination
4.1 If one of the parties wishes to terminate the booking prematurely, this can only be made known via the Cancel Booking form on Showbird.com. In the event of a cancellation, the standard of reasonableness and fairness is applied, with Dutch legislation as the lower limit.
4.1.1 In the event of cancellation by the Client, the Contractor will (via Showbird) refund the following to the Client:
(i) Cancellation more than 3 months before the execution date: 90% of the compensation.
(ii) Cancellation 3 to 2 months before the performance date: 50% of the fee.
(iii) Cancellation less than 2 months before performance date: no refund.
4.1.2 In the event of cancellation by the Contractor, the Contractor will (via Showbird) refund 100% of the fee to the Client.
4.1.3 In all cases of cancellation, ShowBird reserves the right to withhold a maximum of 10% of the fee as compensation for the service and costs incurred.
5. Obligations and Liability
5.1 Obligations and liability of the contractor and the client with regard to the performance are regulated in existing legislation. This Agreement is exclusively governed by Dutch law.
5.2 A party that is of the opinion that there is a dispute is obliged to report this in writing to Showbird within 24 hours after the occurrence. Showbird Netherlands B.V. is not a party to disputes between the Contractor and the Client, but will do its best to mediate between the parties, even though it cannot be obliged to do so.
5.3 Any dispute arising from or related to this Agreement will be submitted to the competent court in Amsterdam, without prejudice to the right of the Parties to request a preliminary injunction.
